Junior Solicitor - Sec 106

Salary: £40 - £45 per hour + Umbrella rate
Location: Luton

 

Connect2Luton are excited to recruit a Junior Solicitor on behalf of Luton Borough Council.

Main purpose of position:

To support the Council in recovering debts, with a focus on enforcing obligations imposed in S.106 Town & Country Planning Act 1990 agreements and advising the client department on strategy, options and policy.

To assist in the provision of legal service to the Council, its Executive, its Committees and Sub-Committees and to Departments (including Senior officers and elected members).

To undertake civil litigation on behalf of the Council and to advise Client Departments on litigation related issues which takes into account Council's business needs and objectives under the supervision of the Senior Civil Litigation Officer and Principal Solicitor.

You will be responsible to:

·Assist with debt matters within the Litigation Dept in particular debts arising from planning developments. Ensuring effective case management, preparation of cases, and attending hearings under the direction and supervision of the Senior Civil Litigation Officer, dealing with all stages of debt legal cases and the issuing and defending of actions, to include producing letters before action, Claim Forms, Statements of Case and Witness Statements.

·Appearing an advocate in the County Court on behalf of the Council in relation to Debt cases. Undertake County Court litigation in relation to the seeking recovery of debts and enforcing obligations under S. 106 agreements, in order to meet the needs of the Client Department and assist with the management of the Council's budgets under instruction from the Client Department and Senior Civil Litigation Officer.

·Prepare and apply for Injunctions to ensure S.106 provisions are enforced order to meet the needs of the Client Department and to address problems caused by anti-social behaviour.

·Give Legal advice to Senior Officers and Elected Members of the Council on matters of law. Post Holder may be required to assist in giving legal advice to Executive, Committees and Sub-Committees or other groups of Members and Officers as may be required.

·Participate in projects relating to corporate, interdivisional or interdepartmental work as may be required by the Senior Civil Litigation Officer or Principal Solicitor (Litigation) or Head of Legal Services to enable the Council to formulate and implement policies in accordance with the law under the direction of the Senior Civil Litigation Officer.

Skills and Experience:

  • Experience of civil litigation in the County Court, including appearing in court
  • Experience of effectively managing resources to achieve value for money and provide a high quality service
  • Experience of debt recovery cases
  • Ability to draft documents
  • A clear and systematic approach to problem solving, an awareness of business risk, and to present legal risks in the context of the client's needs
  • Ability to represent the Council at meetings of the Executive/Committees and at meetings with other public authorities and give sound advice on matters of law and procedure
  • Ability to carry a case load of matters under the supervision of the Senior Civil Litigation Officer
  • Able to demonstrate ability to plan, organise and prioritise own caseload within broad guidelines
  • Competent ICT skills including basic keyboard skills, familiarity with word-processing packages, case management systems and simple databases or ability to acquire the same
  • Working knowledge and understanding of the legislation and procedures relating to section 106 Town & Country Planning Act 1990
  • Working knowledge of Debt recovery and Section 106 enforcement , Civil Procedure Rules, Local Government Law and GDPR
  • Applicants must be Admitted Solicitors, Barristers or Fellows of CILEX qualified in England and, in the case of solicitors, hold (or be able to obtain) a current practising certificate
